Rules for using To Donate as a creator, viewer, or partner, covering paid messages, payments, and widgets.

1. Acceptance

By using To Donate, you accept these terms. If you do not agree, you must not use the platform. These terms apply to creators, viewers, and anyone who accesses our services.

2. Use of service

To Donate allows viewers to send paid messages to creators. Creators can display these messages in stream widgets, QR codes, support goals, and progress bars when these options are active on their account.

Some features may depend on technical, financial, or operational validation before becoming available for a specific account or payment method.

3. Account and security

Creator access is handled through OAuth providers such as Google or Twitch. You must keep your provider account secure and notify us if you suspect unauthorised access.

4. Content

Viewers and creators are responsible for the content they send or display. The platform must not be used for harassment, fraud, spam, illegal content, infringement of third-party rights, hate speech, or infrastructure abuse. We may apply basic automated moderation, remove content, delete messages, or limit accounts to protect the platform, creators, and viewers.

5. External integrations

Creators may choose to link external accounts, such as YouTube/Google, Twitch, Streamlabs, StreamElements or game integrations (CS2), to validate channels, select streams, read relevant events, send alerts to external tools, or display alerts on widgets. The connection is made through the respective provider's authorisation mechanism and can be disconnected in To Donate settings or revoked directly with the provider where applicable.

By connecting these integrations, the creator authorises To Donate to access and process the data described in the Privacy Policy. In particular: (i) by activating the YouTube chat robot, the creator authorises To Donate to publish public messages in the live chat on their behalf; (ii) by connecting Streamlabs or StreamElements, the creator authorises the forwarding of the name, message and donation amount to those platforms; (iii) by installing the game configuration, the creator transmits their game state to To Donate.

The creator is responsible for ensuring they have permission to connect the channel, use live data, forward audience data, and display events on their stream, and for complying with the terms of service of external platforms, including the YouTube API Services Terms of Service. To Donate does not control the rules, availability, quotas, reviews, or technical changes of external platforms, and an integration may become limited, unavailable, or require new authorisation.

6. Payments

Payments may be processed by EuPago, Stripe, or the providers indicated at the time of payment. The message should only be released for automatic display after payment is confirmed.

To Donate's fee depends on the active payment flow and is shown before payment: in the EuPago flow it is 0% per confirmed payment; in the Stripe flow it is 0% on tips. Stripe fees are deducted directly from the creator's Stripe account.

Pix payments are processed in BRL through Stripe and are subject to applicable conditions in Brazil.

Chargebacks, refunds, tax obligations, value settlement, and anti-fraud rules depend on the payment provider, the creator's account rules, and applicable law.

To receive real payments or settlements associated with EuPago, the creator may need to complete a financial onboarding process, submit identification, tax, banking, and corporate documents where applicable, and keep this data correct and up to date. To Donate may review these elements internally, share them with EuPago for KYC/KYB validation, and store the technical identifier assigned to the creator for future operation. Activation, suspension, refusal, settlement, and split of amounts depend on validations by To Donate, EuPago, anti-fraud rules, and applicable law.

7. Public messages

By sending a paid message, the viewer accepts that the name provided, the message, and the amount paid may appear publicly on the stream, widget, or creator page.

When the creator activates a support goal, paid amounts may be used to update a progress bar on the widget or the creator's public page. These goals are configured by the creator and are for community information purposes; To Donate does not verify or guarantee the purpose stated by the creator, except where required by law or platform rules.

Refund requests, where applicable, will be analysed according to the payment method, provider rules, and applicable law. Content removed for violating these terms may not automatically qualify for a refund.

8. B2B Advertising

To Donate may provide a marketplace connecting creators to advertising brands. Creator participation is strictly optional and requires express opt-in; no creator is enrolled automatically. Commercial terms, including any revenue share, are presented to the creator before any campaign association. Brand creatives may be shown as overlays on the stream, triggered by events configured by the creator.

9. Availability

We strive to keep the service available but do not guarantee uninterrupted operation. We may change, suspend, or discontinue features for technical, legal, or security reasons.

10. Liability

To the extent permitted by law, To Donate is not liable for indirect losses, stream interruptions, loss of revenue, user-generated content, or acts of third-party providers.

11. Applicable law

These terms shall be governed by and construed in accordance with applicable Portuguese and European legislation, without prejudice to mandatory consumer rights. For users residing in Brazil, the mandatory provisions of Brazilian consumer law and the LGPD also apply.
